Assignments    Legal Consultants are being engaged to: -<br />   (i) deal with court cases of the Commission which include  monitoring  of aLI court cases,  taking  up timely  action<br />with regard to filing Affidavit/Counter etc.<br />(ii) giving advice to the Commission on legal matters.<br />(iii) assisting Hon'ble  CbairmanlVice-ChairmanlMembers  of the Commission  in matters  related  to hearing  in legal<br />perspective.<br />(iv) apprise the Commission with latest/landmark judgments concerning affairs of the Commission.<br />*  Numbers  of  vacancies   may  be  increased  or  decreased   without   notice  depending   on<br />requirement of the NCSC.<br />Other Conditions of Engagement<br />1. Working Hours:  Working  hours of the Commission  is from  9.30 Hrs to  18.00 Hrs.<br />However,  in the exigency  of work, Consultants may be required  to sit late and attend office  on  Saturdays  /  Sundays! Holidays.  No  compensatory  leave  will  be  given  for attending  office  on  Saturdays!  Sundays/  Holidays.  Consultants  would  be  required  to <br /></p><p>compulsorily    enrol  themselves    in Aadhaar   based  Biometric   Attendance    System   (BAS)<br />and mark their  attendance   at the time of arrival  and departure<br />2.  Leave:    Paid   leave   @  1.5 days  for  each  completed  month,  subject  to  approval  of controlling officer. There will be no accumulation of leave beyond a calendar year<br />3. Performance   Appraisal:   A quarterly Performance Appraisal of the Consultants will be done to bring objectivity  in the assessment  of performance  of consultants.  Assessment will  be done by  the controlling  officer  and the  same  would  be  the  basis  for further continuation or termination of the legal consultant, as the case may be.<br />4. Termination:   National Commission for Scheduled Castes may terminate the contract for engagement as legal consultant at any time under any of the following conditions.<br />(i)  Legal Consultant unable to address the assigned works.<br />(ii) Quality of output of Legal Consultant not to the satisfaction of the Commission. (iii)      Legal Consultant failed to do the work within the prescribed time.<br />(iv)   Legal Consultant lacking in honesty and integrity.<br />(v)  The Commission  also reserves the right to terminate the contract unilaterally by giving  15 days'  notice.  Legal  Consultant  will also  have  the  right  to end  the contract  by giving  15 days'  notice. Legal  Consultant's   Notice  Period  can  be curtailed with the approval of competent authority.<br />5. Applicability  of Official Secrets Act & other  relevant  Acts/Rules  etc ..<br />Legal  Consultant  will  be  governed  by  the  Official  Secrets  Act,  1923 and  shall  not<br />disclose any information / data that they may gather by virtue of being legal consultant in NCSC, to any unauthorised person during or after period of their engagement as Legal Consultant  in the Commission.  In this regard their attention  is also  drawn  to various Circulars issued by the CVC/other Statutory Bodies under which any misuse of official position makes them accountable and triable under due process of law. Legal Consultant must work and act at all times, in the interest of the Commission and render service with professional integrity, transparency, competitiveness and courtesy.<br />6. Submission  of Files/Cases:  Legal Consultants will be required to submit their files/cases through their controlling officers.<br />7.  Procedure   for  Selection:  All applications received will be scrutinized,  shortlisted and will be placed  before a Screening Committee. The Screening Committee  will  interact with the shortlisted  candidates and recommend a panel, including waitlisted candidates. Recommendations of the Screening Committee will be placed before the competent authority for approval.<br />8.  The NCSC reserves the right to cancel the advertisement, at any stage. Department/ Public Sector Enterprise/Private Sector Organization/Institution should be as on 20.01.2022.<br />2.6     Internship training shall not be considered as work experience for the post of Senior Officer<br />(Medical Services).<br />2.7  Experience of candidates working on contract basis through an empanelled agency/ contractor (i.e., those who have been deployed on contract basis by some other agency/ organization) will not be considered. Only direct work experience including fixed term basis employment in an organization will be taken into consideration.<br />3. UPPER AGE LIMIT AND AGE RELAXATION<br />3.1 The Upper Age Limit for various posts as given in Table-II is as on 20.01.2022.<br />3.2 The upper age is relaxable by 05 years for SC/ST category candidates, 03 years for OBC (NCL) category candidates. It is also relaxable by 10 years for PwBD candidates belonging to General/EWS category, 13 years for PwBD candidates belonging to OBC (NCL) category and 15 years for PwBD candidates belonging to SC/ST category. The above relaxation in upper age limit is applicable only in respect of posts which are reserved for SC/ST/OBC(NCL) category candidates. Relaxation in age limit shall be applicable for PwBD category candidates irrespective of the fact whether the post is reserved or not, provided the post is identified suitable for concerned PwBD category candidates. Depending on the number of candidates fulfilling all criteria, candidates will undergo single stage/ multiple stage selection process. In the event of number of applications being large, GAIL will adopt shortlisting criteria to restrict the number of candidates to be called for further selection process to a reasonable number by suitably raising the minimum eligibility standards.<br />9.2 Screening and selection will be based on the details provided by the candidates, hence it is necessary that only accurate, full and correct information is furnished by the applicants. The number of vacancies indicated against each category is provisional. The upper age limit is relaxable upto 5 years for SC and 3 years for OBC as per Government orders in force only in those cases where the posts are reserved for respective categories, on production of relevant certificate in the prescribed format signed by the specified authority.<br />b. The Certificate for Backward Caste must clearly indicate that the candidate does not belong to the persons/sections (Creamy Layer) mentioned in Column 3 of Schedule to the Government of India, Department of Personnel & Training O.M. No. 36012/22/93-Estt(SCT) dated 8/9/93 as amended from time to time. The OBC certificate should be in the format FOR APPOINTMENT TO POSTS UNDER THE GOVERNMENT OF INDIA with reference to relevant Government of India Orders meeting the Creamy Layer Criteria as laid down by Government of India and not for appointment in any of the States bearing references to those State Government Orders. OBC candidate’s eligibility will be based on Castes borne in the Central List of Govt. of India. Upper age limit is relaxable upto 5 years for the regular employees working in CSIR Laboratories / Institutes, Government Departments, Autonomous Bodies and Public Sector undertakings only for Receptionist post.  There will be no age restriction in the case of Departmental Candidates for the post of Junior Secretariat Assistants and Junior Stenographer.<br />e. As  per  GOI  provisions,  age  relaxation  for  Widows,  Divorced  Women  and  Women  Judicially separated from Husbands, who are not remarried, the upper age limit is relaxable up to the age of<br />35 years (upto 40 years for members of Scheduled Castes/Scheduled Tribes and upto 38 years for members belonging to the Other Backward Classes in respect of the posts reserved for them). The persons claiming age relaxation under this sub-para would be required to produce the following<br />documentary evidence:<br />i.In case of Widow, Death Certificate of her husband together with the Affidavit that she has not remarried since.<br />ii. In case of divorced Women and Women judicially separated from their husbands, a certified copy of the judgement/decree of the appropriate Court to prove the fact of divorce or the<br />judicial separation, as the case may be, with an Affidavit in respect of divorced Women that they have not remarried since. <br />f.    Age relaxation of 10 years for Unreserved [total 15 years for SC and 13 years for OBC candidates]<br />in upper age limit shall be allowed to Persons with Benchmark Disability (PwBD). g.   Relaxation in case of ex–servicemen will also be applicable as per provisions.<br />h.   Relaxation of five years will also be permissible to those who had ordinarily been domiciled in the<br />Kashmir division of the state of Jammu and Kashmir during the period from 1-1-1980 to 31-12-<br />1989 subject to production of relevant certificate from the concerned authority.<br />i. Selection for the post of JSA (GEN/F&A/S&P): The candidates fulfilling all necessary eligibility criteria as recommended by the Screening Committee will be invited for open competitive written examination and typewriting test on computer. The written exam will consist of two papers (Paper-I<br />& Paper-II). Paper-II will be evaluated only for those candidates who secure the minimum threshold marks (to be determined by the Selection Committee) in the first paper (Paper-I). The proficiency in computer typing speed and in using computer will only be qualifying in nature. The final merit list will be prepared on the basis of the performance in the competitive written examination in Paper-II, who have qualified the proficiency in computer typing. Syllabus for the examination is attached herewith as  Annexure-I<br />2. Selection for the post of Junior Stenographer: The candidates fulfilling all necessary eligibility criteria as recommended by the Screening Committee will be invited for open competitive written examination and stenography.<br />The proficiency in stenography will only be qualifying in nature; the final merit list will be prepared on the basis of the performance of the candidates in the competitive written examination. The merit list will comprise of those candidates who have qualified the proficiency test in  stenography. Syllabus for the Examination/Test is attached herewith as  Annexure-II<br />3.
